Пропозиції до вдосконалення законодавчого врегулювання сектору безпеки і оборони у контексті критичної інфраструктури

Abstract

У роботі пропонуються шляхи вдосконалення законодавчого регулювання сектору безпеки і оборони України з урахуванням актуальних викликів, пов'язаних з війною РФ проти України та важливості захисту критичної інфраструктури. Проаналізувавши поточний стан законодавства щодо цієї проблеми були виявлені певні прогалини та неточності у визначеннях. У статті запропоновано конкретні заходи щодо удосконалення законодавства. Пропозиції спрямовані на уточнення суб’єктного складу сектору безпеки і оборони у сегменті критичної інфраструктури. Виокремлені функції об’єктів критичної інфраструктури, які напряму корелюють з забезпеченням поточних та потенційних потреб, життєво важливих інтересів, добробуту людини і громадянина. Проведено наукове обґрунтування доречності внесення змін до чинних нормативних актів у контексті складових сектору безпеки і оборони.

This article proposes ways to improve the legislative regulation of the security and defense sector of Ukraine, taking into account the current challenges associated with the war of the Russian Federation against Ukraine and the importance of protecting critical infrastructure. Having analyzed the current state of legislation regarding this problem, certain gaps and inaccuracies in the definitions were revealed. The article proposes specific measures to improve legislation. The proposals are aimed at clarifying the subject composition of the security and defense sector in the critical infrastructure segment. The functions of critical infrastructure objects, which are directly correlated with the provision of current and potential needs, vital interests, human and citizen well-being, are singled out. A scientific justification of the appropriateness of making changes to the current regulatory acts in the context of the components of the security and defense sector has been carried out.
